ORDER
Heard the Learned Counsel for the Appellant Mr. Arun Karthik Mohan. He informs that before this ‘Tribunal’, IA 908/2023 in Comp.App.(AT)(CH) No. 22/2022, is filed by the parties jointly, seeking permission from this ‘Tribunal’ to withdraw the instant Comp.App.(AT)(CH) No. 22/2022based on the ‘Terms of settlement’ and ‘Share Purchase Agreement’ dated 25.08.2023.
The above factum of the ‘Terms of the settlement’ and the ‘Share Purchase Agreement’ dated 25.08.2023 have not been disputed by the Learned Counsel Mr. T.K. Bhaskar appearing for R1.
In view of the fact that the ‘Terms of settlement’, have been arrived at between the parties and they have filed the instant IA No. 908/2023 jointly, accepted the ‘Terms of Settlement’, coupled with the Share Purchase Agreement dated 25.08.2023, this ‘Tribunal’, accords ‘permission’ to the ‘Appellant’ to withdraw the instant Comp. App (AT)(CH) No. 22/2022 on the file of this Appellate Tribunal and recording the said fact the Comp. App (AT)(CH) No. 22/2022 is dismissed as withdrawn. No costs. The connected IA No. 231/2022, IA No. 232/2022 and IA No. 908 / 2023 are closed.
