Judgment
This is an application under Rule 11 of NCLT Rules read with Section 60(5) of the IB Code for withdrawal of the CP No. 546 of 2019 on account of subsequent developments in the matter.
We have heard the submissions made by the counsel. The developments which have taken place in this matter and the developments which have motivated the Applicant to withdraw the present application are detailed in para 6 to 9. The Applicant has further stated that she is keen to receive the home for herself and in the light of the recognition of her right by the Ld. Receiver on the basis of books maintained by Amrapali, subsequent payment stated to have been made by her and the contents of the reply of the Respondent made the Applicant to seek leave of this Tribunal to withdraw the present CP No. 546 of 2019. The Applicant has also stated that the application has been filed bonafidely in the interest of the justice. Therefore having regard to the contents of the application as well as prayers made in the application this Tribunal permits the Applicant to withdraw the CP No. 546 of 2019 and the matter as such is dismissed as withdrawn in terms of Rule 8 of IB (Application to Adjudicating Authority) Rules, 2016. The case folders and connected papers may be consigned to Record Room and the present IA for withdrawal is allowed. The matter stands disposed of in all respects.
