Judgment
ORDER
This is an application under Section 60(5) of the Insolvency and Bankruptcy Code, 2016 read with Rule 11 of NCLT Rules, 2016 seeking the withdrawal of the Company Petition No. IB/186/ND/2020 in view of the settlement arrived between the parties.
Having heard the submissions made by the Learned Counsels present at the time of hearing and having noted the contents of the application, the Section 9 application bearing petition No. 186/ND/2020 is dismissed as withdrawn in terms of Rule 8 of IBBI (Application to Adjudicating Authority) Rules, 2016. The corporate debtor is directed to ensure that it regularly pays the rent to the operational creditor without any default on future occasions. The case papers may be sent to record room.
