Judgment
Heard the learned counsels appearing for the parties and perused the documents on record.
The petitioner has been made an accused in Maheshpur P.S. Case No. 25 of 2017 corresponding to G.R. No. 122 of 2017, registered for offence under Section 25(1?a)/26/35 of Arms Act.
Referring to order granting bail to co?accused?Sukhchand Sk., the learned counsel for the petitioner submits that allegation against the petitioner is similar to what has been alleged against co?accused?Sukhchand Sk.. It is submitted that in Maheshpur P.S. Case No. 26 of 2017 the petitioner has already been granted bail vide order dated 05.06.2017 in B.A. No. 4510 of 2017. The petitioner is in judicial custody since 03.03.2017. A charge?sheet has already been submitted in this case.
The learned APP opposing the prayer for grant of bail submits that from the possession of the petitioner one country?made pistol was recovered.
Having regard to the aforesaid facts and circumstances of the case, the petitioner, above?named, is directed to be released on bail on furnishing bail bond of Rs.10,000/? (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Pakur in connection with Maheshpur P.S. Case No. 25 of 2017 corresponding to G.R. No. 122 of 2017, on the following conditions :
(i) one of the bailers shall be a class?I legal heir of the petitioner, (ii) he shall remain physically present on each and every date during the trial, except for special circumstances, (iii) he shall not change his place of residence without permission of the Court, and (iv) he shall file attendance in the office of Superintendent of Police, Pakur on every Sunday between 9.00?10.00 a.m. 6. The instant application is allowed. Let a copy of the order be transmitted to the trial Court through ''Fax''.
Let a copy of the order be transmitted to the Superintendent of Police, Pakur, for ensuring compliance of the above condition by the petitioner.
