Heard the learned counsels appearing for the parties and

perused the documents on record.

The petitioner has been made an accused in Giridih (M)

P.S. Case No.06 of 2017, which was registered for the offence under

Sections 25(1-b)a/26/35 of Arms Act.

Referring to orders granting bail to the petitioner in

other two cases, the learned counsel for the petitioner submits that

the petitioner, who is in judicial custody since 06.01.2017, deserves

bail.

Opposing the prayer for grant of bail, Mr. Ashish Jha, the

learned APP submits that a loaded country-made pistol was

recovered from the possession of the petitioner.

Considering the orders granting bail by other

co-ordinate Benches of this Court, the petitioner, Jagdish Sao, is

directed to be released on bail on furnishing bail bond of

Rs.10,000/-(Rupees ten thousand) with two sureties of the like

amount each to the satisfaction of the Learned SDJM, Giridih in

connection with Giridih (M) P.S. Case No.06/2017, corresponding to

G.R. No.45/2017, on the following conditions:

(i) he shall appear before the trial court, regularly,

(ii) he shall not change his place of residence without prior

permission of the court, and

(iii) he shall be personally present in the office of the Superintendent

of Police, Giridih on every Sunday between 9 am to 10 am and a

report on his conduct shall be forwarded to the trial court from the

office of the Superintendent of Police, Giridih every month.

The instant application is allowed. Let a copy of the

order be transmitted to the trial Court and the office of the

Superintendent of Police, Giridih through ''FAX''.
