Judgment
Mohd Nasir and Mohd Shakir S/o Mohd Yusuf have filed the present application under the provisions of the National Green Tribunal Act, 2010 for taking action against Mr. Sumit Kumar, (JEE, CMC-1), Mr. Aritanshu, (JEE, CMC-1) and Mr. Ramesh Chandra (EE-CM-1) of Delhi Pollution Control Board and Police Officer Mr. Surabh for giving wrong information regarding property bearing no. 1461, Gali No. 52, Jafrabad, Delhi.
The applicants have submitted that they have filed criminal complaint against Mohd. Rehan for doing illegal commercial activities on ground and first floor of the property in question. MCD has submitted status report that Mohd. Rehan is doing Commercial activities at the above said property. The officials, whose names are mentioned above, have filed wrong report that no commercial activity are going on in the above said property by deliberately concealing the material facts and taking illegal remuneration from Mohd. Rehan.

The grievance of the applicants is regarding giving of wrong/false information by the officials named in the application that no commercial activities were going on in the property in question and the applicants have sought taking of action against them. On due consideration of the material on record, we are of the view that there is no question relating to environment arising out of implementation of the enactments specified in schedule I to the National Green Tribunal Act, 2010 involved in the present case. Therefore, no intervention by this tribunal in exercise of its jurisdiction/powers under the National Green Tribunal Act, 2010 is warranted and the present application is disposed of accordingly.
