Judgment
Application under Section 18 (1) read with Section 14, 15, 16,and 17 of the National Green Tribunal Act, 2010.
ORDER
Mr. Gyanender Singh Rana resident of H.No. 514, Shahbad Daulat Pur, Delhi has sent the present application complaining that buffalo dairies are being run illegally without any licence from MCD in residential area. The dairies are using submersible pumps and throwing buffalo dung in the drainage/sewer/open Naali causing serious water and air pollution posing health hazards to the residents of the locality. The dairies in question have not shifted to the site allotted by MCD/Government agencies in Ghoga Village. The applicant has further complained regarding burning and dumping of plastic and rubber waste by illegal Bangladeshi migrants in open at Firni Road at back side of Gulmohar Garden in Shahbad Daulatpur Village causing serious air and water pollution.
Prima facie, the allegations made in the application raise question relating to the environment arising out of the implementation of the enactments specified in Schedule I to the National Green Tribunal Act, 2010. In view of the allegations made in the application, we consider it appropriate that a Joint Committee of the concerned statutory authorities be asked to verify the factual position and take remedial action on the basis thereof. We accordingly constitute Joint Committee of the concerned Statutory Authorities-Commissioner, Delhi Municipal Corporation, Delhi Pollution Control Committee (DPCC) and District Magistrate (North West) Delhi and direct the same to verify the factual position, look into the grievances of the applicant and take remedial action as mandated by the statutory provisions empowering them in accordance with law after following due process. DPCC will be the nodal agency for coordination and compliance.
Factual and action taken report may be furnished within two months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Supported PDF and not in the form of Image PDF, before the Ld. Registrar General, National Green Tribunal, Principal Bench, New Delhi who may, if necessary, put up the matter before this Bench for further directions.
The application is disposed of accordingly.
A copy of this order, along with a copy of the application and documents attached with the same, be forwarded to the Commissioner, Delhi Municipal Corporation, DPCC and District Magistrate (North West) Delhi by e-mail for compliance.
