Judgment
Heard Mr. M.A.K. Mukheed, learned counsel for the petitioner; and Mr. M. Arun Kumar, learned Standing Counsel for GHMC appearing on behalf of respondent Nos.2 and 3, and perused the material available on record.
A show-cause notice vide notice No. 1/106/TPS/W11/C34/GZ/ GHMC/2026 dated 28.07.2026 was issued to the petitioner stating that he had unauthorisedly constructed tin-shed slabs on the ground and first floors and had encroached upon the road margin and the neighbouring premises, in violation of the provisions of the Greater Hyderabad Municipal Corporation Act, 1955 (for short 'GHMC Act') and G.O.Ms.No.168 dated 07.04.2012. The grievance of the petitioner is that the respondent authorities are going ahead with the enquiry pursuant to the show-cause notice and are attempting to pull down the temporary structures raised by him, pending regularisation application dated 01.08.2026 submitted by him under Sections 455A and 455AA of the GHMC Act.
Learned Standing Counsel for respondent Nos. 2 and 3 submitted that, apart from the unauthorised structures, there are allegations that the petitioner has encroached upon the public road and the neighbouring property.
However, learned counsel for the petitioner submitted that the said allegations are incorrect and that the petitioner has raised only temporary structures.
In the light of the above submissions, the writ petition is disposed of with a direction to respondent No. 2 to consider the petitioner's regularisation application vide Inward No. CTZ2026062642 dated 01.08.2026 in respect of the subject property bearing H. No. 11-1-106, CIB No. B-40, admeasuring 121.75 square yards, situated at Aghapura, Nampally, Hyderabad, by conducting necessary enquiry to ascertain whether there is any encroachment upon the road margin and the neighbouring property. Subject to the outcome of such enquiry, respondent No. 3 - Deputy Commissioner, Greater Hyderabad Municipal Corporation, Circle No. 34, Masab Tank, Golconda, Hyderabad, is directed to proceed with the enquiry pursuant to the impugned show-cause notice dated 28.07.2026. Until such exercise is completed, no coercive steps shall be taken against the petitioner in respect of the subject property. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in this writ petition stand closed.
