Judgment
Ravindra Maithani, J
Applicant is in judicial custody in Case Crime No. 340 of 2024, under Sections 303 (2), 317 (2), 109, 352, 351(3), 61 (2) (a) of the Bharatiya Nyaya Sanhita, 2023 and Section 3 of the Prevention of Damage to Public Property Act, 1984, Police Station Jaspur, District Udham Singh Nagar.He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
According to the FIR, the applicant is driver of the vehicle which was transporting sand without any royalty. When police signalled the vehicle to stop, it did not stop, instead the applicant tried to hit the police personnel, who somehow managed to escaped. Subsequently, the truck was apprehended. There are other allegations also in the FIR.
Learned counsel for the applicant would submit that the applicant did not injure anyone. It is a case fit for bail.
Learned State counsel admits that it is no injury case.
Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
