Sonit @ Soni vs State Of Uttarakhand

Applicant- Sonit @ Soni is in judicial custody in FIR No. 95 of 2021, under Sections 379, 511 & 34 of IPC, Section 3 of the Public Property (Prevention of Damage) Act, 1985 and Section 15/16 of the Petroleum and Minerals Pipeline (Acquisition of Right of User in Land) Act, 1962, Police Station Bhagwanpur, District Haridwar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

It is argued that all the co-accused have already been granted bail.

Learned State Counsel would submit that the applicant has history of six criminal cases.

To it, learned counsel for the applicant would submit that applicant is not a previous convict. Out from one report, five cases have been lodged against the applicant. One case is lodged based on some alleged confession of the applicant.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
