Applicant is in judicial custody in FIR No. 539 of 2024, under Section 3/4 Prevention of Damage to Public Property Act, 1984, Section 3/5/11 of the Uttarakhand Protection of Cow Progeny Act, 2007, Section 121 (1)/132/191 (2)/263 of the Bhartiya Nyaya Sanhita 2023 and Section 125 of the Bharatiya Nagarik Suraksha Sanhita, 2023, Police Station Bhagwanpur, District Haridwar. She has sought her release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 02.07.2024, the police raided a premises and recovered beef and other articles and arrested the applicant, but when the police was trying to take her away, many co-accused obstructed the police party in discharge of their duties. Stones were also pelted, which damaged the Government vehicles also.

Learned counsel for the applicant would submit that the applicant did not cause any obstruction. Eighteen co-accused have already been granted ad-interim anticipatory bail in the matter. No specific role as such has been assigned to the applicant.

Learned State counsel would submit that beef and some articles were recovered from the applicant.

Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on her executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
