Heard Mr.Abdul Kabeer, learned counsel for the petitioner; learned Assistant Government Pleader for Medical and Health appearing for respondent No.1 and Mr. T.Sharath, learned Standing Counsel appearing for respondent No.2. Perused the record.

2.

The instant writ petition is filed seeking a direction to the respondents to consider the candidature of the petitioner for admission to the MBBS/BDS course under Management Quota "C" (NRI Quota).

3.

The contention of learned counsel appearing for the petitioner is that the petitioner herein had applied for admission to the MBBS course through NEET-2026 under the Management Quota C-Category, which is otherwise referred to as Category-II (NRI Quota). In order to substantiate his claim for consideration under the said category, the petitioner had submitted certain documents relating to his NRI sponsorship. The person sponsoring the petitioner is his father, who is admittedly an NRI. However, the documents forwarded by the father through the Embassy of the State of Qatar were received only subsequently, by which time the applications were already made and the counselling process had already progressed. Hence, the petitioner has filed the present Writ Petition seeking a direction to the respondents to permit him to participate in the next round counselling, subject to his fulfilling the requisite eligibility criteria for being considered as a candidate under the NRI Quota.

4.

Sri T. Sharath, learned Standing Counsel for respondent No.2 submits that subject to the petitioner furnishing the requisite documents in support of his claim, respondent No.2 would consider the case of the petitioner and permit him to participate in the next round of counselling, subject to his fulfilling the requisite eligibility criteria for being considered as an NRI candidate.

5.

The submission made by the learned Standing Counsel appearing for respondent No.2 is fair and, in view thereof, no purpose would be served by keeping the writ petition pending. Accordingly, the Writ Petition is disposed of with a direction to the petitioner to furnish before the respondent No.2 all the relevant documents in support of his claim for admission under the NRI Quota.

6.

Upon submission of the said documents, respondent No.2 shall scrutinize the same in accordance with the applicable guidelines, notwithstanding the fact that the documents were submitted at a belated stage. If, upon such scrutiny, the petitioner is found eligible and otherwise fulfils the requisite eligibility criteria for admission under the NRI Quota, he shall be permitted to participate in the subsequent round of counselling.

7.

With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
