Judgment
Heard learned counsel for the petitioner, Mr. N. Bhujanga Rao, learned Deputy Solicitor General of India and learned Assistant Government Pleader of Home for respondents No.2 to 4.
Learned Assistant Government Pleader of Home and learned Deputy Solicitor General of India submitted that the petitioner is facing prosecution in CC.No.2760 of 2020 in the Court of the II Additional Junior Civil Judge cum XXV Additional Junior Magistrate of First Class, Ranga Reddy District at Rajendranagar transferred from XI Additional Metropolitan Magistrate, Cyberabad at Rajendranagar, Ranga Reddy District. LOC has been issued against the petitioner in connection with Cr.No.1260 of 2022 for the offences under Sections 498-A of the Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act. It is submitted that when a criminal case is pending, the petitioner cannot be permitted to approach this Court seeking suspension of LOC. The petitioner is required to file an appropriate application before the trial Court seeking suspension of LOC in case the petitioner intends to travel abroad.
In view of the above, the writ petition is disposed of giving liberty to the petitioner to file an appropriate application before the trial Court seeking suspension of LOC. As and when such application is filed, the trial Court shall pass orders, within one week thereafter, in accordance with law. In case, relief is granted to the petitioner, the LOC opened against the petitioner shall be suspended by the trial Court for the corresponding period of travel.
The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
