Judgment
Heard learned counsel for the petitioners, learned standing counsel for Central Government and learned Assistant Government Pleader for Home.
Petitioners are A2 to A4 in Cr.No.211 of 2023 of Women Police Station, Hyderabad, registered for the offences under Sections 498-A and 406 of the Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act. The petitioners are presently residing in Doha, Qatar.
Learned counsel for the petitioners submitted that Look Out Circular has been issued against the petitioners in connection with Cr.No.211 of 2023 of Women Police Station Hyderabad. Subsequently, investigation was completed and charge sheet has been filed before the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. The trial Court took cognizance of the charge sheet and registered the same as CC.No.160 of 2024.
Learned standing counsel for Central Government submitted that if the petitioners intend to come to India and travel back to Doha, Qatar or any other country, they are required to take permission from the trial Court. As and when permission is granted, automatically, the LOC opened against the petitioners would be suspended.
In the light of the above submissions, taking note of the fact that the petitioners are residing in Doha, Qatar and facing prosecution in CC.No.160 of 2024, this Court is not inclined to pass any orders.
However, the writ petition is disposed of giving liberty to the petitioners to file an appropriate application before the trial Court for suspension of LOC in case petitioners intend to visit India and travel back to Doha, Qatar. As and when such application is filed, the trial Court shall pass orders in accordance with law. In case, relief is granted to the petitioners, the LOC opened against the petitioners shall be suspended by the trial Court for the corresponding period.
The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
