Judgment
This Criminal Petition is filed by the petitioners/accused Nos.1 to 4 seeking to quash the proceedings in C.C.No.106 of 2025 on the file of the learned Judicial First Class Magistrate at Adilabad.
Heard Ms.P.Sumalatha, learned counsel representing Mr.C.D.S.B. Venkata Rao, learned counsel for the petitioners and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent No.1.
Though the present petition has been filed seeking quashing of the proceedings on various grounds, during the course of arguments, learned counsel for the petitioners restricted her relief on the ground that the matter before the trial Court has not yet ripened for trial. She further submits that petitioner No.1 is residing in Saudi Arabia due to his employment, petitioner No.2 is a housewife, and petitioner Nos.3 and 4 are eking out their livelihood through private employment. Unless this Court dispense with the personal appearance of the petitioners before the trial Court, they will be put to great hardship. She further submits that the petitioners will appear before the trial Court whenever their presence is required and will represent the matter through their counsel on each and every date of adjournment.
The learned Additional Public Prosecutor has not opposed the submissions made by the learned counsel for petitioner.
During the course of hearing, learned counsel for the petitioners submits that petitioner No.4/accused No.4 will appear before the learned trial Court.
In view of the above submissions, the presence of the petitioner Nos.1 to 3/accused Nos.1 to 3 in C.C.No.106 of 2025 on the file of the learned Judicial First Class Magistrate at Adilabad, is dispensed with, subject to the condition that petitioner Nos.1 to 3/accused Nos.1 to 3 shall be represented through their counsel on each and every date of hearing. If the presence of the petitioner Nos.1 to 3/accused Nos.1 to 3 is required, they shall appear before the trial Court. In case of their non-appearance on the specific date fixed by the trial Court for his appearance, the trial Court is entitled to proceed with the matter, in accordance with law.
Accordingly, the criminal petition is disposed of.
Pending miscellaneous applications, if any, shall stand closed.
