This Criminal Petition has been filed by the petitioner/accused No.2 seeking to quash the proceedings in P.R.C.No.19 of 2025 on the file of the III Additional Judicial Magistrate of First Class, at Warangal.

Heard Mr.K.Karuna Sagar, learned counsel for the petitioners and Mr.V.Jithender Rao, learned Additional Public Prosecutor for respondent No.1.

Though the criminal petition was filed seeking to quash the proceedings in P.R.C.No.19 of 2025, learned counsel for the petitioner has restricted his prayer and requested this Court to dispense with the appearance of the petitioner/accused No.2 in P.R.C.No.19 of 2025, on the ground that the petitioner is eking out his livelihood by doing a small business and he will appear before the trial Court whenever his presence is required. Unless this Court dispenses with the presence of the petitioner, he will be put to great hardship.

The learned Additional Public Prosecutor has not opposed the submission made by the learned counsel for petitioner.

In view of the above submissions, and without expressing any opinion on the merits of the case, the presence of the petitioner/accused No.2 in P.R.C.No.19 of 2025 on the file of the III Additional Judicial Magistrate of First Class, at Warangal, is dispensed with, subject to the condition that he shall be represented through his counsel on each and every date of hearing. If the presence of the petitioner is required, he shall appear before the trial Court. In case of his non-appearance on the specific date fixed by the trial Court for his appearance, the trial Court is entitled to proceed with the matter, in accordance with law.

Accordingly, the criminal petition is disposed of. Pending miscellaneous applications, if any, shall stand closed.
