Challenging rejection of the petitioner's complaint dt.11.07.2025 (Mee Seva Application No.15201107251641332593) by order dt.17.09.2025, this Writ Petition is filed.
It is submitted that the petitioner has filed an application seeking issuance of Non-traceable Certificate / Loss Certificate in respect of his Passport bearing No.V895721. It is stated that the petitioner has lost his passport while he was shifting from his own house at Syed Ali Guda to a rented house at Saber Nagar within the same locality of Asifnagar, Hyderabad and thereafter, he lodged a complaint before respondent No.3 through Mee Seva on 11.07.2025. However, his application has been rejected vide order dt.17.09.2025 by observing that he did not produce the relevant documents.
Learned Assistant Government Pleader for Home, on written instructions, submitted that in the application, the petitioner did not state the details such as when he shifted from his old residence to new residence, when he noticed that his passport was missing or the reasons for reporting the alleged loss only on 09.07.2025. It is further submitted that the petitioner failed to explain why he had submitted the application on 09.07.2025 after a gap of more than 2 years seeking issuance of a police clearance certificate/verification certificate. It is further stated that the petitioner failed to produce any photostat copy of his passport in support of his claim. Learned Assistant Government Pleader for Home therefore reiterated the submissions made in the written instructions dt.14.08.2026.
Learned counsel for the petitioner submitted that the petitioner is a senior citizen and intends to travel abroad for religious purposes and he has made the application for issuance of non-traceable certificate / loss certificate so as to enable him to make an application for duplicate passport.
Learned counsel for the petitioner has also referred to the decision of a Division Bench of A.P. High Court (as it then was) in the case of Mirza Asghar Hussain vs. The Commissioner of Police, Hyderabad and others (W.A.No.303 of 2010 dt.23.06.2010) in support of his contention that whenever there is an application made with regard to loss of passport, the SHO concerned has to register an FIR and issue certified copy of the FIR to the complainant to enable him to obtain duplicate passport.
In view of the same and in view of the reason for rejecting the application of the petitioner being only that the petitioner did not produce the relevant documents, this Court is inclined to set aside the rejection order dt.17.09.2025 and direct the respondents to verify the passport number given by the petitioner and if it is found that there was no misuse of the and if the validity of his passport has not expired, then the respondents shall reconsider the application of the petitioner afresh and issue the required certificate along with a certified copy of the FIR registered in this regard expeditiously.
The Writ Petition is accordingly disposed of. No order as to costs.
Pending miscellaneous petitions, if any, in this Writ Petition shall stand closed.
