Judgment
Aggrieved by the order of rejection dated 01.06.2025 rejecting the application of the petitioner for issuance of an FIR/missing certificate in respect of Passport No.A 396368, without assigning any reasons, this writ petition has been filed.
Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home, appearing for the respondents 1 to 3.
The learned counsel for the petitioner submitted that the petitioner was issued Passport No.A 396368 and though it expired in the year 2007, the petitioner made an application for issuance of a missing certificate only in the year 2025, as he intended to travel abroad, and the said application has been rejected without assigning any reasons therefor.
The learned Assistant Government Pleader for Home has filed a copy of the written instructions received by him, according to which, the complaint of the petitioner was vague and did not disclose the basic facts necessary for taking further action and, therefore, the request has been rejected.
However, this Court finds that the order of rejection is not a speaking one and does not refer to the details which are required for processing the application. Therefore, the order of rejection is set aside and the petitioner is directed to approach the concerned Station House Officer, who shall thereafter require the petitioner to furnish the documents that are necessary and, after considering the explanation, if any, of the petitioner, appropriate action for issuance of the certificate shall be taken.
With these directions, the writ petition is disposed of. No order as to costs.
Miscellaneous applications, if any, pending shall stand closed.
