Judgment

This application under Article 227 of the Constitution of India has been filed seeking directions for early disposal of Title Suit. No. 3 of 1996 which was renumbered as Title Suit. No. 25 (T) of 2005 and subsequently as Title Suit. No. 28 of 2017, which is pending before the court of the learned Presiding Officer, District Council Court, Shillong. The only prayer by the petitioner who is the defendant in the said Title Suit before this Court is that the matter be taken up expeditiously.
The respondent who is stated to be the plaintiff is not before this Court and though the order sheets reflect that three attempts had been made to serve notice, the same was unsuccessful. However, it appears that for the purpose of disposal of the revision application, appearance of the respondent/plaintiff is not important or necessary inasmuch as, the prayer is only for expeditious disposal and in fact will serve the cause of justice.
Accordingly, this civil revision application is disposed of with a direction to the trial court namely, the court of learned Presiding Officer, District Council Court, Shillong where the Title Suit. No. 28 of 2017 is pending, to dispose of the same as expeditiously as possible preferably within a period of 10(ten) months from the date of receipt of this order. This direction is passed in view of the fact that it appears that the said Title Suit has been pending for over a period of 25 years.
With the above direction, matter is closed and stands disposed of.
