Judgment

This revision application has been preferred under Rule 6 of the High Court of Meghalaya (Jurisdiction over District Council Courts) Order, 2014 read with Article 227 of the Constitution of India, assailing the impugned order dated 16-08-2023, passed by the Presiding Officer, Subordinate District Council Court, Shillong in Misc. Case No. 69 of 2023, arising out of Title Suit No. 29 of 2023.
By the impugned order, ad-interim injunction had been granted in favour of the petitioner restraining her agents and assigns from encroaching, trespassing, collecting rent etc.
The grievance as put up by the petitioner is that though the matter is at a very nascent stage and the order is ad-interim in nature, which will still be subject to consideration by the trial court, the long date given by the trial court for filing of show cause and for hearing the matter has compelled her to approach this Court by way of this instant revision application.
Ms. S.K.Nongrum, learned counsel who has entered appearance on behalf of the respondent submits that the matter is yet to be agitated fully and the final injunction matter is yet to be heard. The same is not disputed by the learned counsel for the petitioner.
On perusal of the materials on record and on the submissions of the learned counsel for the parties, without delving into the merits of the matter or the claims and counter claims, in view of the fact that the matter is yet to be to be decided by the trial court on the injunction matter, this Civil Revision application is closed with the following directions:
(i) The petitioner herein who is the defendant of the party in the pending suit shall file the show cause to the injunction application within one week from today.
(ii) The learned trial court thereafter, on receipt of the same, shall dispose of the injunction matter preferably within a period of four weeks thereafter.
(iii) Till the injunction matter is finally decided, status quo shall be maintained by all the parties with regard to the suit premises.
Parties are put to notice to appear on 24-11-2023 before the learned trial court.
With the above directions, the instant Civil Revision application stands disposed of.
