Judgment
Heard Mr. S. Chanda, learned counsel for the petitioner.
Also heard Mr. S.M. Suna, learned counsel for the respondents No. 1 & 2.
This is an application under Article 227 of the Constitution of India with a limited prayer for this Court to direct the Trial Court i.e. the learned Presiding Officer, Sub-Ordinate District Council Court, Jaintia Hills Autonomous District Council, Jowai to dispose of the pending Title Suit No. 21 of 2013 between the parties herein within a stipulated timeline, the fact being that the said suit has been pending for about 13(thirteen) years or so.
This Court, on consideration of the prayer made, and as agreed to by the parties, would make it clear that no specific timeline can be fixed for disposal of the case by the Trial Court, and no forthcoming direction in this regard can also be issued by this Court. However, in the interest of justice, considering the fact that the matter has indeed been pending for a very long time, this Court, while disposing of this application, would request the Trial Court to take up the matter expeditiously, to ensure that the parties should not suffer unnecessarily for prolongation of the matter.
In view of the above, this petition is disposed of accordingly.
