Judgment
Heard Sri K. Jagdishwar Reddy, appearing on behalf of the petitioner and Sri N. Sreedhar Reddy, learned Standing Counsel for TSSPDCL, appearing on behalf of respondent.
This Contempt Case is filed complaining violation of the order of this Court dated 17.03.2023 passed in W.P. No.6557 of 2023.
PERUSED THE RECORD.
The relevant portion of the order of this Court dated 17.03.2023 passed in W.P. No. 6557 of 2023 is extracted hereunder:
"Taking into consideration the orders dated 27.05.2021, 21.07.2022 and 11.11.2022 referred to and extracted above, there shall be interim direction to the 3rd respondent to furnish the information as sought for by the petitioner in petitioner's application dated 26.04.2021 within a period of (3) three weeks from the date of receipt of the copy of this order without reference to the proceedings vide Lr.No.DEE/OP/BPLY/T/F.RTI/D.No.344/2021, dated 05.05.2021 of the Divisional Engineer/Electrical, Operation Division, Bowenpally i.e., 3rd respondent".
Relevant portion of the Counter affidavit filed by respondent in particular para Nos.3 and 4 are extracted hereunder:
'3. I submit that the above Contempt Case is filed by the petitioner to punish the Respondent herein for willfully and deliberately flouting the orders passed in W.P. No.6557 of 2023 dated 17.3.2023. I submit that pursuant to the directions of this Hon'ble Court in W.P. No.6557 of 2023 dated 17.3.2023, all the required information that was sought for by the petitioner has been furnished to him under R.T.I. Act. Therefore the allegation of the petitioner that this Respondent has violated the directions of this Hon'ble Court is absolutely incorrect and the same is made for extraneous considerations.
4.I submit that I have got great respect to this Hon'ble Court and the orders issued by this Hon'ble Court and I never intend to violate any of the directions of this Hon'ble Court, much less willfully. I submit that the present Contempt Case is filed in the month of August 2025 alleging violation of the order passed by this Hon'ble Court on 17.3.2023 in W.P. No. 6557 of 2023. The petitioner has failed to explain as to how the above Contempt Case is maintainable, which is filed after lapse of more than one year. On this ground alone, the above Contempt Case is liable to be dismissed with exemplary costs. In any event of the matter, as I have complied with the directions of this Hon'ble Court, the above Contempt Case is not maintainable. I submit that petitioner herein, who is a chronic litigant, has filed the above Contempt Case even though the directions of this Hon'ble Court are implemented in toto. I am a law abiding citizen and would never violate the directions of this Hon'ble Court. I hereby tender my unconditional apology if this Hon'ble Court finds any omissions and commissions on my part in implementing the directions of this Hon'ble Court. There are no merits in the above Contempt Case and the same is liable to be dismissed by this Hon'ble Court".
Taking into consideration the specific averments made in the counter affidavit filed by the respondents in particular at para Nos.3 and 4 referred to and extracted above, this Court opines that there is no contempt as alleged by the petitioner.
Accordingly the Contempt Case is closed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending shall stand closed.
