Judgment

Mr. R. Debnath, learned CGC has submitted that the department has not yet been able to locate or find out the letters said to have been sent by the petitioner, whereby her overstay of leave has been explained and even on the basis of the postal receipt produced by the petitioner, the related documents or letters have not yet been located. It is therefore prayed that some more time may be allowed for the department to make an effort to locate such letters and to file an affidavit in this regard within the next date fixed.
Mr. W. Jyrwa, learned counsel for the petitioner has submitted that this matter has already been heard and at this point of time, the learned CGC coming up with this plea will not be permissible for the respondent to do so. However, keeping in mind the query made by this Court which issue would have a bearing on the merits of this case, this Court would grant further time to the respondent to take necessary steps.
As prayed for, list this matter after 2(two) weeks.
