01/ Learned counsel for the applicant submits that the applicant has been transferred from PW (R&B) Division Handwara to the newly created R&B Division, Kralpora, Kupwara vide impugned order NO. CEPWD (R&B) K-110 (Adm) of 2023 dated 30-08-2023, issued by respondent NO.2. It is further submitted that the applicant, in this regard, has filed a representation before the respondents on 31-08-2023, which is pending disposal before them. Learned counsel further submits that it will be suffice if a direction is issued to the respondents to consider the said representation and take a decision thereon within a stipulated period.
02/ Mr. Waseem Gul - GA appears. He submits that the representation has been filed by the applicant just two days before filing of the instant O.A, as such, this O.A is not maintainable.
03/ Be that as it may, in view of the limited prayer made by learned counsel for the applicant, respondents are directed to consider the representation of the applicant dated 31-08-2023 within two weeks from the date a copy of this order is served on them. Needful to be done in accordance with law by passing a reasoned and speaking order. Respondents are further directed not to relieve the applicant from the present place of posting unless already relieved.
04/ With this, the O.A. 694/2023 shall stand disposed of along with connected M.As.
