Judgment
Ld. Counsels representing their respective parties are present through VC.
IA NO.41/2023 & IA NO.40/2023 IN CP No.54/ALD/2022
In this case, the reply on behalf of respondent nos.1, 4 and 9 has already been filed.
Ld. Counsel representing the petitioner states that the rejoinder to the reply filed on behalf of the aforesaid respondents has also been filed with the Registry on the e-portal on 18.03.2023, with copy thereof already supplied to the counsel opposite.
Ld. Counsel representing the respondent nos.1, 4 & 9 however states that no such rejoinder has been filed and infact they have moved an IA no.41/2023, which is listed today as a fresh application seeking closure of the right of the petitioners to file rejoinder. Be that as it may, since the rejoinder has already been filed on 18.03.2023 on the e-portal, the same is taken on record.
The Ld. Counsel representing the petitioners undertakes as under :-
i. He would be filing the hard copy of the petition as well as the copy of the rejoinder to the reply filed on behalf of respondent nos.1, 4 and 9 with the Registry of this Tribunal, within a period of one week.
ii. He also undertakes to supply the copy of the rejoinder to the opposite counsel on the email ID to be shared in the chat box within one week from today.
In view of the aforesaid order, IA No.41/2023 becomes infructuous accordingly.
Another application bearing IA No.40/2023 has also been filed on behalf of the petitioner, which is listed today as a fresh application seeking closure of the rights of the remaining respondent nos.2, 3, 5, 7 & 8 from filing their replies.
We deem it appropriate to grant time to the aforesaid respondent nos.2, 3, 5, 7 & 8 for filing their replies within a period of two weeks positively, failing which, their right to file replies shall be deemed to be closed.
In view of the aforesaid order, IA No.40/2023 stands disposed off accordingly.
Let the main matter be adjourned for further hearing on 18th January, 2024.
