In   this   original   application,   grievance   is   in   respect   of encroachment, pollution, reduction of area of the pond in Smriti Van which is a DDA park at Kishangarh Village.

Tribunal  by  order  dated  21.02.2023  had  constituted  the  joint committee. A report of the joint committee along with status report of Weltland Authority has been filed which discloses that the area of the pond has been reduced and pond has been polluted by throwing the muck and discharge of sewage water.

Learned Counsel appearing for District Magistrate, South Delhi has submitted that action has been initiated against the encroachers.

Though,  Delhi  Pollution  Control  Committee  (DPCC)  was  earlier represented through advocate but no one is present today on behalf of DPCC to appraise the Tribunal about the action taken for violations and against the violators and also to remediate the situation and restore the pond to its original position.

Hence, in view of the material which has come on record, District Magistrate, South Delhi and DPCC are now required to take requisite action for restoration of the pond, removal of encroachment, identification of violators and action against them for committing the violations of environmental norms.

Let necessary action in this regard be taken by District Magistrate, South Delhi and DPCC within three months and report be submitted before Registrar General of the Tribunal within two weeks from expiry of three months and if found necessary, the matter will be listed before the
