Judgment
The petitioner is seeking a direction to official respondents to protect his life and liberty, as he apprehends threat from the accused, after lodging FIR No.448 dated 29.07.2017 under Sections 323 / 384 / 506 IPC registered at Police Station Sector-5, Gurgaon.
Learned counsel for the petitioner contends that he had earlier approached this Court by preferring CRM No. M-31250 of 2017 which was disposed of on 07.09.2017 (Annexure P-1) with a direction to respondent No.2 to look into the representation of the petitioner and take action, if necessary in accordance with law expeditiously. He further contends that although a month has elapsed since the passing of order, but no action has been taken by respondent No.2.
Learned counsel also contends that petitioner has been again threatened by the accused, who are also following him whenever he ventures out of his house.
Issue notice to the respondents.
At the asking of Court, Mr. Vikramjit Singh, Additional Advocate General, Haryana, accepts notice on behalf of respondents. A complete set of paper-book be supplied to him during the course of day.
Without expressing any opinion on the merits of the case, the instant petition is disposed of with a direction to respondent No.2- Commissioner of Police, Gurgaon, to look into the representation dated 28.07.2017 (Annexure P-5) of the petitioner and take action, if necessary, in accordance with law, within a period of 15 days.
