Judgment
ORDER
From the perusal of the record, it appears that an Interlocutory Application No. 445 of 2022 has been filed under Rule 11 of the NCLAT Rules, 2016 for placing on record Additional Documents in Company Appel (AT) No. 02 of 2022, which is taken on record.
In terms of the Order dated 07.01.2022, Learned Counsel for the Appellant has filed Order sheet of National Company Law Tribunal, New Delhi, Principal Bench vide Order dated 06.01.2022 passed in CA- 594/ 2021 & CA-602/ 2021, whereby, the following order was passed which is as hereunder:-
“Notice of the Applications to the Non-Applicants-Respondents for 03.02.2022. At request list the matter on 03.02.2022.”
Further, it was informed by the Learned Counsel for the Appellant that the matter is adjourned for 03.03.2022.
Learned Counsel for the Appellant has impugned the Order dated 02.09.2021 passed by the National Company Law Tribunal, New Delhi, Principal Bench in CA- 172/ 2020 & CA- 173/ 2020, whereby, the matter was directed to be listed on the top of the list on 15.09.2021.
The Instant Appeal has been filed on 23.12.2021 vide Diary No. 32461.
Heard, Learned Counsel for the Appellant and Respondent Nos. 1,2,6, 12, 14 & 17.
In view of the facts, this matter is still pending before the Learned Adjudicating Authority, hence this Appeal is hereby disposed of with the direction to the Learned NCLT, New Delhi, Principal Bench, to consider all the plea raised by the Appellant Counsel and disposed of the Appeal filed in CA No. 172 of 2020 & CA No. 173 of 2020 in CP No. 78 of 2016 as expeditiously as possible preferably within eight weeks.
