Judgment
Pursuant to Order dated 29.07.2021 Learned Counsel for the Appellant has filed the complete Order Sheet passed by the Learned National Company Law Tribunal, New Delhi, Principal Bench in CA- 131 (PB)/ 2021.
From the perusal of the Order Sheet it appears that the Learned National Company Law Tribunal, New Delhi, Principal Bench directed the Respondents to file Reply within four weeks and the matter was directed to be listed on 20.05.2021.
Further, Order Sheet also indicates that on 20.05.2021 the matter was directed to be listed on 28.07.2021 as the matter could not be taken up.
Thereafter, again on 28.07.2021 the matter was directed to be listed on 10.09.2021. could not be taken up due to COVID-19 Pandemic situation and the matter was directed to be listed on 28.07.2021.
From the perusal of the Order Sheet and hearing the Learned Counsel for the Parties we hereby directed to Learned Counsel for the Appellant to appear before the Learned NCLT, New Delhi and file his Reply Affidavit on or before the next date i.e. 10.09.2021 in CA No.- 131 (PB)/ 2021.
In the Reply apart from answering on the merits, Learned Counsel for the Appellant may take the grounds on maintainability of the Petition.
Learned Counsel for the Respondent opposed the submissions made by Learned Counsel for the Appellant.
After hearing he Parties, this Appeal stands disposed off with the aforesaid directions.
Registry is directed to upload the Order forthwith on the website of this Appellate Tribunal.
Registry is directed to send the copy of the Order to the Adjudicating Authority, National Company Law Tribunal, Principal Bench.
