Judgment
Heard Learned Counsel for the Appellant.
Learned Counsel for the Appellant preferred this Instant Appeal against the Order dated 06.04.2021 passed by the Learned Adjudicating Authority (National Company Law Tribunal, New Delhi, Principal Bench) in I.A.-1659/2019 in IB- 22(PB)/ 2018 in, which is reproduced as hereunder:-
"This is an application for approval of resolution plan along with the objections to be listed for hearing along with the all pending application
List ton 04.05.2021."
In terms of the Order dated 19.08.2021 Learned Counsel for the Appellant has filed the Additional Affidavit bringing on record the Order sheet of NCLT, New Delhi Bench, whereby, the Order dated 24.08.2021 of the NCLT, New Delhi is as hereunder:-
"List the matter for further consideration on 28.09.2021".
Further, Learned Counsel for the Respondent No. 1/ RP has filed an Affidavit supporting the case of the Appellant.
Learned Counsel for the Appellant submits that the matter will be listed before the Adjudicating Authority on 14th December, 2021.
After hearing the parties, we allow this Appeal i.e. Company Appeal (AT) (Ins.) No. 609 of 2021 with the following direction:-
(i) The Learned Adjudicating Authority taking in view of the Resolution Plan that they file I.A. No. 1659/ 2019 filed in IB-22(PB)/ 2018 is adjourned from time to time.
The Learned Adjudicating Authority is requested to expedite the hearing in I.A. No. 1659 of 2019 filed in IB- 22(PB)/ 2018 pertaining to Resolution Plan is preferably disposed of within eight weeks from the receipt of this Order.
The Registry is directed to upload this Order on the website of this Appellate Tribunal.
Registry is directed to send a copy of the Order to the National Company Law Tribunal, New Delhi Bench.
