Judgment
This Appeal has been filed against the order dated 02.06.2022 by which the Adjudicating Authority (National Company Law Tribunal), New Delhi, Principal Bench, on the request of the Counsel, fixed date for physical hearing on 15.07.2022.
Learned counsel for the Appellant submits that I.A. No. 1758/2021 filed by the Appellant is pending consideration for more than one year. Learned counsel for the Appellant submits that this Tribunal by its order dated 27.10.2021 passed in Company Appeal (AT) (Ins.) No. 857 of 2021 had requested the Adjudicating Authority to decide the application I.A. No. 1758/2021 within three weeks, which was pending since April, 2021.
Learned counsel for the Resolution Professional Shri G. P. Madaan submits that all the applications are being heard by the Adjudicating Authority which have already been categorized.
Be it as it may. Learned counsel for the Appellant submits that application for approval of Resolution Plan is also pending before the Adjudicating Authority, hence, I.A. No. 1758/2021 needs to be decided at an early date. In view of the above, we request the Adjudicating Authority to consider and take decision on I.A. No. 1758/2021 at an early date. With these observations, this Appeal is dismissed.
