After some argument, learned counsel for the petitioner seeks permission to withdraw this writ application in order to approach the appellate authority.

Learned counsel for the petitioner fairly submits that even the appellate authority has dismissed the appeal of the petitioner but in the given facts and circumstances of the case, this Court may direct the appellate authority to re-visit with the order, looking to the overall facts and circumstances of the case.

Learned counsel for the respondents does not oppose the prayer for withdrawal of the writ application and for again approaching the appellate authority.

Having regard to the aforesaid facts and circumstances of the case, the instant writ application is hereby disposed of by giving liberty to the petitioner to approach the appellate authority, if so advised. If the petitioner approaches the appellate authority, it shall re-visit with its order without being prejudiced to the order already passed by it, in accordance with applicable rules and regulation and looking to the overall facts and circumstances of the case. It goes without saying that this Court has not given any finding on the impugned order at all.
