Judgment
Per Krushna Ram Mohapatra, Chief Justice
Heard.
Appellant in this writ appeal seeks to assail the order dated 07.08.2026 passed by the learned Single Judge in WP(S) No.2380/2022 (Annexure-A/1).
During the course of hearing, learned counsel for the appellant submits that in a similarly situated case, this Court set aside the order of the appellate authority and remitted the matter to the appellate authority for fresh consideration of the appeal. He, therefore, submits that he may be permitted to withdraw the writ appeal to enable the appellant to move the authority for a similar treatment.
Learned counsel appearing for the respondents No.2 to 6 submits that although he does not have any objection for withdrawal of the writ appeal, but the case of the appellant has already been rejected by the learned Single Judge. Thus, he should not be permitted to make any fresh application to consider his appeal afresh.
In view of the submission made by the learned counsel for the parties, this Court disposes the writ appeal as withdrawn with an observation that the petitioner, if so advised may workout his remedy in accordance with law before the appellate authority.
It is made clear that this Court has not expressed any opinion on the merits of submission made by the learned counsel for the appellant.
