Judgment
In this writ petition the petitioner has prayed for issuance of appropriate direction upon respondent No.3 i.e. the Land Acquisition Officer, Bokaro for payment of compensation with respect to 26.5 decimals of land/buildings of Plot No.502 and 503 under Khata No.44, mouza Bhawanipur (Solagidih), P.S.- Chas, District-Bokaro which has been acquired for the purpose of broadening NH-32.
The petitioner has limited his prayer and submitted that he has filed the representation dated 22.09.2015, annexed at Annexure-7, before the Additional Collector, Bokaro and the copy of the same was given to the Deputy Commissioner, Bokaro and Land Acquisition Officer, Bokaro praying for the compensation but till date the concerned officers have not taken any decision on the representation nor passed any order in the matter.
The learned counsel for the State submits that the land in question is Gair mazarua land.
Heard. Considering the limited prayer of the petitioner, the Land Acquisition Officer, Bokaro is directed to take a decision and pass a reasoned and speaking order on the representation dated 22.09.2015, annexed at Annexure-7, filed by the petitioner. The respondents shall pass necessary order in accordance with law within four weeks from the date of receipt or production of a copy of this order after giving an opportunity of hearing to the parties.
With the said direction, this writ petition is, hereby, disposed off.
