Judgment
Heard learned counsel for the petitioner.
Petitioner in this writ petition seeks for a direction to the opposite parties to pay the compensation amount pursuant to notice dated 25.5.2018
vide Annexure-5 and to dispose of the representation within a stipulated time.
Learned counsel for the petitioner submits that petitioner is the recorded owner over Plot No. 2859/3053 under Khata No. 283/194 measuring
an area Ac.0.040 dec. which was acquired by the authority for expansion of National Highway in village Gundichapada in the district of
Dhenkanal. Pursuant to which L.A Case No. 55/54/2012 was initiated and award was passed. He further submits that pursuant to the notice
dated 25.5.2018 vide Annexure-5 issued to the petitioner by opposite party No. 2-Competent Authority-cum-Special Land Acquisition Officer,
N.H., Dhenkanal the compensation amount has not yet been paid to him for which he has filed a representation before the said authority on
1.8.2018 vide Annexure-4/1. Petitioner has already received compensation as per notice dated 4.11.2015 vide Anhnexure-2 but he has not
received the compensation as per notice vide Annexure-5 nor his representation has yet been considered by opposite party No. 2 till date.
Considering the above limited grievance of the petitioner and without going into the merit of the case, we dispose of the writ petition with a
direction to opposite party No. 2-Competent Authority-cum-Special Land Acquisition Officer, N.H., Dhenkanal to disburse the compensation
amount, if there is no other impediment as reflected in notice dated 25.5.2018 vide Annexure-5 to the petitioner within a period of three months
from the date of receipt of a copy of the order and consider the representation of the petitioner dated 1.8.2018 vide Annexure-4/1 within a period
of four weeks from the date of production of the certified copy of the order along with a copy of the writ petition.
