Judgment
The applicant in person. He claims to be an expert in Rain Water Harvesting System (RWHS) and his grievance is that Delhi Metro Rail Corporation (DMRC) is constructing or has constructed RWHS which are not efficient enough to take care of the problem and instead they should be directed to get opinion/assistance from the applicant for construction of an efficient and proper functional RWHS. Applicant has stated that DMRC has floated a tender for maintenance of RWHS though the system already installed is not properly functional and, in this regard, if the applicant is permitted to assist for installation of proper functional RWHS that will help the public cause.
We have gone through the entire matter and we find that this application is not within the four corners of the issues which this Tribunal can entertain under Sections 14, 15, 17 and 18 which are mentioned in this application under which applicant has sought to invoke jurisdiction of this Tribunal. We do not make any comment on the competency and the knowledge of the applicant with regard to RWHS but applicant cannot invoke jurisdiction of this Tribunal to seek a certificate of appreciation regarding his self-acclaimed competence and for augmenting his own professional or commercial interest with regard to construction/ installation of RWHS. Applicant's endeavour to get recognition for himself by using judicial forum is nothing but a gross abuse of process of law. This forum cannot be allowed to become a platform for an individual's own accomplishments so as to certify his so called expertise. Such applications, not only are not maintainable, but ought not to have been filed. Presently, we are refraining from imposing any cost upon the applicant, but for future, we hope and trust that applicant will not file such frivolous applications.
The application is rejected.
