Judgment
This is an original application filed under Section 14 of the NGT Act, 2010 read with Article 51A and Article 21 of the Constitution of India and Environment (Protection) Act, 1986 and Water (Prevention and Control of Pollution) Act, 1974 stating that Effluent Treatment Plants (ETPs) sought to be installed by respondents would not be effective for treating remains of cow dung, urine and bio-medical waste etc. and therefore for efficacy of proposed ETPs another expert Committee be appointed which may include applicants also since applicants are is self-claimed experts in the matter and thereafter appropriate effective ETPs should be installed.
Infact applicants want a certification of their so-called expertise on the subject doubting expertise of authorities concerned who are proceedings to installs ETPs for dealing with dairy waste in Ludhiana.
In the absence of any material to show that the ETPs installed would not properly and effectively function and environmental norms would not be followed, we do not find that the issue raised by this application raises any issue which is adjudicable under Section 14 of the NGT Act, 2010. The application is misconceived and is dismissed.
