Judgment

The petitioners, who apprehend arrest at the hands of the respondent police, for the alleged offences punishable under Section 41 (1)(d) and 102 Cr.P.C and Sections 457 (2) and 380 (2) of I.P.C., in Crime No.17 of 2023, seeks anticipatory bail.
The case of the prosecution is that the petitioners and other accused stolen the idols worth about Rupees Ten Crores along with Car.
The learned counsel appearing for the petitioner submits that the petitioners are innocents and they are in no way connected with the alleged offence.
The learned Government Advocate (Crl.Side) raised serious objection and also sought time for filing counter.
Considering the rival submission made and considering the facts and circumstances of the case and considering the nature of allegation, interim anticipatory bail is granted to the petitioners enabling them to appear before the respondent Police for investigation. The petitioner shall appear before the respondent Police daily at 10.30 a.m. for a period of one week from 21.04.2024 onwards and co-operate for the investigation.
The respondent Police is directed to file a report as to the role of the petitioners in the offence on the next date of hearing. Post the matter on 26.04.2024. Till such time, the petitioner shall not be arrested.
