The petitioner, who apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Section 454 and 380 I.P.C, in Crime No.123 of 2023, seeks anticipatory bail.
The case of the prosecution is that the petitioner and other accused came in a Car bearing Registration No.TN-06-D-0020 and also break opened the locker and has taken away a sum of Rs.34,00,000/-, which was kept in the locker.
The learned counsel appearing for the petitioner submits that the petitioner is an innocent and he is in no way connected with the alleged offence.
The learned Government Advocate (Crl.Side) submits that the petitioner and other accused have break opened the locker and taken away a sum of Rs.34,00,000/-, which was kept in the Community Locker.
Considering the objections of the learned Government Advocate (Criminal Side) and considering the facts and circumstances of the case, interim anticipatory bail is granted to the petitioner enabling him to appear before the respondent Police for investigation. The petitioner shall appear before the respondent Police daily at 10.30 a.m. for a period of one week from 20.04.2024 onwards and co-operate for the investigation.
The respondent Police is directed to file a report as to the role of the petitioners in the offence on the next date of hearing. Post the matter on 26.04.2024. Till such time, the petitioner shall not be arrested.
