This is an application under Section 151 CPC for recalling the order dated 04.01.2024.
For the reasons stated in the application, which is supported by an affidavit, the application is allowed and the order dated 04.01.2024 is recalled and the main case is ordered to be restored to its original number.

This is a civil writ petition filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to stay the departmental proceedings till the conclusion of the criminal case pending against the petitioner.
Learned counsel for the petitioner seeks to withdraw the present petition with liberty to file a fresh petition after laying down challenge to the order dated 19.10.2023 (Annexure P-2) as well as after specifically stating the stage of the criminal case and the departmental proceedings and also after annexing the list of witnesses in the criminal case and in the departmental proceedings.
In view of the statement made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty.
It is made clear that in case any such petition is filed, the same would be considered independently.
