The Divisional Engineer, Operation, Southern Power Distribution Company of Telangana Limited, Tandur, Vikarabad Circle, Vikarabad.

Sri R. Sushanth Reddy, learned counsel appears for appellant/respondent No.1.

Sri N. Sreedhar Reddy, learned Standing Counsel for Southern Power Distribution Company of Telangana Limited appears for respondent Nos.1 to 3/writ petitioners.

The instant Writ Appeal is preferred against the interim order dated 21.07.2026 passed by the learned writ Court, in Writ Petition No.23444 of 2026.

In the facts and circumstances of the case and after hearing the learned counsel for the parties, we are of the opinion that since Writ Petition No.23444 of 2026 is posted for today before the appropriate Single Bench where apparently the appellant has not even filed a counter-affidavit or vacate stay petition, it would not be desirable for this Court to go into the merits of the contentions raised by the appellant or by the respondent company.

Learned counsel for the appellant has not produced any notice issued after the interim order under appeal dated 21.07.2026 passed by the learned writ Court, in the nature of an imminent threat of disconnection of electricity supply pertaining to Service Connection of the appellant.

On the other hand, learned counsel for the respondent company submits that the component of High Tension (HT) arrears is being shown in the current bills of the appellant.

Ordinarily, a notice of disconnection contains 15 days notice period. However, in the facts and circumstances taken note of, the appellant should appear before the learned writ Court in the pending Writ Petition and if so advised, seek suitable time to file its counter-affidavit and vacate stay petition, if any. The learned writ Court is requested to entertain its request and if the counter-affidavit/vacate stay petition is filed within this week, the matter may be taken up for consideration in the next week itself.

With the aforesaid observation, the instant Writ Appeal is disposed of.

Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
