Judgment
Both parties and their counsels are present. Both parties stated that the matter has been settled between them. Filed joint memo of settlement with terms agreed by both the parties. Under consideration is a Company Petition filed by the Sri Krishna Enterprises (in short, 'Petitioner/Financial Creditor') against M/s. Raj Breeder and Hatcheries Private Limited (in short, 'Respondent/Corporate Debtor') under section 9 of the Insolvency and Bankruptcy Code 2016 (in short, I & B Code 2016) Read with Rule 6 of the Insolvency & Bankruptcy (Application to Adjudicating Authority) Rules, 2016 (for brevity, 'IB Rules 2016').
During the hearing held on 21.08.2019, both parties filed joint memo of settlement dated 21.08.2019 and counsel for the Petitioner prayed leave of this Adjudicating Authority to withdraw the present petition.
Memo is taken on record which forms part of the order. Permission is granted for withdrawing this instant petition.
In view of the above, CP (IB) No.180/9/HDB/2018 is hereby closed as withdrawn.
