Matter is listed as per Court direction. It was informed that on 31st July 2020, when this matter was listed for pronouncement, the learned counsels for both the parties made submissions that matter is settled and requested to defer the pronouncement as they are in process of filing of withdrawal application. Accordingly, the pronouncement was deferred but inadvertently registry has uploaded the final order passed in this application on the website. Mr. Piyush Ranjan, states that he has been instructed to appear for IRP. Learned counsel for both the side request to call from the registry the said withdrawal application for consideration today. Accordingly, registry is directed to call for withdrawal application. Let the matter be called out at 12:30 for the same.
IA No. 3138/ND/2020:
Application is jointly filed by Operational Creditor and Corporate Debtor seeking withdrawal of IB-1527/ND/2019. The affidavit of both the parties have been filed stating that parties have amicably settled the matter. Learned counsels for both the sides confirm the same. We allow the application thereby IB-1527/ND/2019 be withdrawn and disposed of.
Mr. Piyush Ranjan appears for IRP and states that publication has already been made. The same is required to be withdrawn by giving public notice in the same newspapers immediately. Mr. Piyush Ranjan confirms that the final order copy was not received by IRP form registry, but the same was supplied by one interested party. IRP is not present. The directions given for withdrawing public notice to be complied forthwith.
