Judgment
This is an application under Rule 11 of NCLT Rules, 2016 seeking reflection of correct name of the Resolution Professional in the order dated 10.06.2022 passed by the Adjudicating Authority in CP No. IB-259 (ND)/2021.
We have heard the submissions made by the Counsel and carefully gone through the order dated 10.06.2022. From the averments made in the application, it transpires that Mr. Anil Tayal was originally proposed by the Applicant to be the IRP in the matter. Subsequently the Applicant has sought for change of IRP from Mr. Anil Tayal to Mr. Anurag Nirbhaya and the said change of IRP application was allowed by the Adjudicating Authority as per law. However it is seen at para 6 as well as at para 12, the name of the Mr. Anil Tayal was reflected instead of Mr. Anurag Nirbhaya. Therefore this Tribunal is now satisfied that change of the name from Mr. Anil Tayal to Mr. Anurag Nirbhaya is legally in order and hence wherever the context require the Resolutions Professional's name may be read as Mr. Anurag Nirbhaya having registration No. IBBI/IPA-001/IP-P00870/2017-18/11468. The order may be read as the part of the order passed on 10.06.2022.
In view of the above, let there be a public notice in this matter that Mr. Anurag Nirbhaya is the IRP appointed in this matter. Mr. Anil Tayal if acted upon the order dated 10.06.2022 received by him for any reason, the same may be communicated to Mr. Anurag Nirbhaya to carry on further duties of IRP and Mr. Anil Tayal is relieved from the duties and responsibilities of IRP in this matter. Mr. Anurag Nirbhaya is directed to take steps and complete the CIRP within time as per law. Let a copy of this order be served on both the IRPs and also concerned. Dasti of this order is allowed. The application is allowed.
