Judgment
An Authorised Representative Mr. Lahri Satsangi from the Accounts Department of the Corporate Debtor present in person. Mr. Vikas Saxena Director of applicant is also present in person. CA No. 172/2019 is filed under Rule 11 of NCLT Rules seeking withdrawal of IB-1250/ND/2018. The said application is filed by IRP appointed by this Bench vide order dated 08.05.2019. Settlement agreement is placed on record duly executed between the Operational Creditor and Corporate Debtor along with application. IRP has filed present application for withdrawal of Insolvency Application, which cannot be entertained Mr. Vikas Saxena director present in person, then has requested orally to allow withdrawal of IB application. And further submits that settlement agreement is placed on record, and DD for Rs. 7,50,000/- is received by Operational Creditor. Oral request to allow to withdraw the application is granted thereby IB-1250/ND/2018 stands withdrawn and disposed of in terms of the above order.
