Judgment
IA No. 5147/ND/2020:
Application filed under Section 12(A) of the Code by IRP seeking withdrawal of the IB-3070/ND/2019. Learned Counsel for the Resolution Professional states that CoC is formed and in pursuance of the settlement, Form ‘FA’ is also submitted by the Operational Creditor. The CoC in its IInd Meeting was appraised about the settlement and after deliberation gave the consent with 100% voting share to allow the withdrawal of the insolvency application. Copy of minutes and voting results are also annexed with Form 'FA'. Learned Counsel for the Operational Creditor and Learned Counsel for the Corporate Debtor are present and confirming the same. Mr. Abhishek, Learned Counsel for the IRP states that nothing is due towards the CIRP cost, fees and other expenses of the IRP. Considering the submission made and documents placed on record, we allow the application, thereby allowing to withdraw the IB-3070/ND/2019. Application is allowed and disposed of in terms of the above order.
IB- 3070/ND/2019stands withdrawn and disposed of.
