Judgment

By filing this application, the applicant has prayed to withdraw the application filed under Section 95 IBC
Heard the submissions made by the Ld. Counsel for the Applicant and perused the averments made in the application as well as no objection certificate by the RP in respect of his dues.
Ld. Counsel for the Applicant submits that although the RP has submitted the report but the application has not been admitted as yet under Section 100 of IBC. Therefore, in view of Rule 11 of IBBI (Application to Adjudicating Authority for Insolvency Resolution Process for Personal Guarantors to Corporate Debtors) Rules, 2019, before the admission, on a request made by the Applicant, the application can be withdrawn.
Considering this fact, we permit the applicant to withdraw the application. Accordingly, the present application i.e. CP No. 143/ND/2021 stands dismissed as withdrawn.
With this, the present IA stands disposed off.
