Judgment
The learned counsel for RP seeks indulgence of the Court and mentioned the application which was listed Yesterday. He further states there is an urgency. The CIRP is already expired on 24th July, 2019 and next CoC meeting is scheduled to be held on 29th July, 2019 but without this application being allowed the CoC will not be able to function. The learned counsel for RP states that the IA No. 227/JPR/2019 is filed for seeking extension of CIRP period yesterday. While considering application, the learned counsel could not find and show the list of CoC Members, and voting sheet annexed. Learned counsel states that due to inadvertence overlooking he could not specifically point out the same, already annexed with the application. The voting sheet and summary report of e-voting is annexed which shows that the resolution with respect to extension of CIRP period at proposed resolution 10 was approved by CoC with 88.61 per cent voting rights. The list of CoC Members with their corresponding claim and e-voting sheet is on record. Considering the submissions made and documents placed on record, the application is allowed and extension of further period of 90 days is allowed from the date of expiry of CIRP period which is from 24th July, 2019. Application is allowed and disposed of in terms of above order.
