Judgment
Advocate Mr. Naishal Mody appearing for the Petitioner Counsel Mr. Pavan Godiawala and filed a copy of a letter of M/s. Reaghan Fashions Pvt. Ltd. informing that another Company i.e. M/s. Liberty Trendz Pvt. Ltd has now amalgamated with it.
Therefore, considering the such changed circumstances as well as the financial position of the said Corporate Debtor because other lenders initiated action for recovery. The present Operational Creditor/Petitioner now does not want to pursue the present matter now and has sought liberty to withdraw unconditionally the present IB petition.
Therefore, the Petitioner Counsel sought withdrawal of the present IB on the basis of above stated, the letter which is signed by its authorised Director of the Company.
By looking to the above given facts and circumstances of the case. The withdrawal letter is accepted and is taken on record.
Consequently, the present CP(IB) 276/9/NCLT/AHM/2018 is dismissed as withdrawn as not pressed for.
