Judgment
ORDER
The Petitioner is represented through their respective Learned Counsel(s).
Learned Counsel of the Petitioner filed pursuits with a request to withdraw IB the present petition, in view of matter is settled out of Court.
It is reported that the Operational Creditor/Petitioner has received Rs. 6,00,000/- as full and final settlement amount of its debt, from the corporate debtor in support of this files present withdrawal pursuits. Hence the present Petitioner seeks to withdraw the present IB petition.
Considering the above, as the matter has been settled for an amount of Rs. 6,00,000/- out of the Court, hence, nothing survives in the present matter, however it is further made clear that our this order shall not operate as res-judicata among the parties. Further other creditor/secured/unsecured, if any, would be at liberty to approach the Competent Court of law including this Tribunal to pursue its remedy in accordance with the law.
With the aforesaid observation the present IB petition CP(IB) CP(IB) 215/2019 is dismissed as withdrawn and settled out of Court.
